MOP is the one rule that trips up EC buyers more than any other. It’s not complicated — but the implications are significant if you’re not prepared.
What Is the EC MOP?
The Minimum Occupation Period (MOP) for Executive Condominiums is 5 years from the date of TOP (Temporary Occupation Permit). You must physically occupy the unit as your primary residence for at least 5 years.
For Tengah Garden Walk EC:
– Estimated construction period: ~3 years
– Estimated TOP: 2029–2030
– MOP ends: approximately 2034–2035
– Can sell as private property: from 2034–2035 onwards
What You Cannot Do During MOP
During the 5-year MOP period, you cannot:
1. Sell your EC unit — not even to an immediate family member
2. Rent out the entire unit — subletting the whole flat is prohibited
3. Own another private residential property — you must dispose of any private property within 6 months of EC key collection
4. Leave Singapore without informing HDB — extended overseas stays need to be declared
What you CAN do during MOP:
– Sublet individual rooms (max 6 renters, must comply with subletting rules)
– Rent out rooms with HDB approval
– Refinance your bank loan
– Transfer ownership to immediate family members (with HDB approval, rare exceptions only)
Why Does This Matter for Your Planning?
MOP has real implications for life events:
Job relocation: If you get posted overseas within 5 years of TOP, you can’t rent out the whole unit. You’ll need to either commute back, make arrangements for family members to stay, or carry the cost of an empty apartment.
Family expansion: If you outgrow the unit during MOP, you can’t sell and upgrade until MOP ends. Plan your unit size for at least 7–8 years of needs (3 years construction + 5 years MOP).
Financial distress: If you need to sell during MOP, there’s no legal way to do so. Plan your finances conservatively.
What Happens After MOP?
After MOP, Tengah Garden Walk EC converts to full private condominium status. This is the key advantage over HDB flats.
Post-MOP, you can:
– Sell to Singapore Citizens, PRs, and foreigners (no HDB restrictions)
– Rent out the entire unit (subject to URA regulations)
– Buy another property simultaneously (subject to ABSD if purchasing a second property)
The transition to private status is what makes ECs compelling investments. The buyer pool at resale is much larger than HDB flats.
The 10-Year Foreign Buyer Eligibility Rule
There’s a further restriction: foreigners can only buy resale EC units that are at least 10 years old (from TOP date). So for Tengah Garden Walk EC:
– From TOP ~2030: SCs and PRs can buy (post-MOP resale)
– From ~2040: foreigners can buy
This 10-year rule means the full international buyer pool doesn’t open until 2040. But in practice, EC resale buyers are predominantly Singaporeans and PRs, so this rarely limits demand significantly.
